Annual Notification of Rights Under FERPA and PPRA

As part of our ongoing commitment to transparency and the protection of student rights, we are providing this annual notification regarding your rights under the Family Educational Rights and Privacy Act (FERPA) and the Protection of Pupil Rights Amendment (PPRA).

These federal laws afford specific rights to parents and eligible students concerning the privacy of educational records and the collection of sensitive information.

 

Family Educational Rights and Privacy Act (FERPA)

FERPA is a federal law that grants parents and eligible students (students who are 18 years of age or older or are attending a postsecondary institution) the following rights:

1. The right to inspect and review your child’s education records within 45 days of submitting a written request to the school.
2. The right to request the amendment of your child’s education records if you believe the records are inaccurate, misleading, or violate the privacy rights of your child.
3. The right to consent to disclosures of personally identifiable information (PII) contained in your child’s education records, except under certain permitted circumstances, as outlined in FERPA.
4. The right to file a complaint with the SC Department of Education concerning alleged failures by the school to comply with FERPA requirements.

 

Protection of Pupil Rights Amendment (PPRA)

The PPRA is a federal law designed to protect the rights of parents and students with respect to surveys, evaluations, and certain marketing activities. Under PPRA, parents and eligible students have the following rights:

1. The right to consent before students are required to submit surveys or evaluations that request sensitive information, such as political affiliations, mental health status, illegal or anti-social behavior, sexual behavior, or other personal topics.
